Anthropic Fights Back: Lawsuit Challenges US Government’s ’National Security Risk’ Label

Silicon Valley's AI darling just lawyered up against Uncle Sam.

The Blockade

Anthropic—the $18 billion AI startup breathing down OpenAI's neck—filed suit in federal court this morning. The target? A recent, quiet designation by a national security panel that slapped the company with a 'foreign adversary technology' tag. No public evidence cited. No detailed findings released. Just a bureaucratic label that could freeze Anthropic out of U.S. infrastructure and contracts.

The Stakes

This isn't just about one company's reputation. The lawsuit argues the government's opaque process sets a dangerous precedent. It gives a nameless committee the power to cripple any tech firm with a secret vote. For the crypto and decentralized tech world watching closely, it's a familiar chill: innovation judged behind closed doors, with national security as the ultimate trump card.

The Fallout

VCs are sweating. A loss here could send valuation multiples for frontier tech firms into a tailspin, proving that the biggest risk isn't product-market fit—it's a faceless committee in Washington. The government now has 30 days to respond. Expect filings, motions, and a blistering PR war.

One thing's clear: the era of polite lobbying is over. When the state calls you a threat, you don't ask for a meeting—you serve papers. And maybe, just maybe, this legal fight will expose how 'national security' has become the go-to excuse for kneecapping disruptive tech that threatens old money and older power structures. After all, what's more secure for the establishment than keeping the future on a government-approved leash?

Anthropic’s lawsuit against the Pentagon alleges that its designation as a “supply chain risk” violates the company’s First Amendment rights and exceeds the government’s authority. The company is asking US courts to undo the supply chain risk designation, block its enforcement, and require federal agencies to withdraw directives to drop the company. While continuing to work with the US government doesn’t appear to be a priority, Anthropic is seeking to prevent officials from blocklisting companies over policy disagreements.

“These actions are unprecedented and unlawful. The Constitution does not allow the government to wield its enormous power to punish a company for its protected speech,” Anthropic said. Furthermore, US President Donald Trump has also directed the government to stop working with Anthropic, whose financial backers include Alphabet’s Google (GOOGL) and Amazon.com (AMZN). Trump and Hegseth said there would be a six-month phase-out.

“Seeking judicial review does not change our longstanding commitment to harnessing AI to protect our national security, but this is a necessary step to protect our business, our customers, and our partners,” an Anthropic spokesperson added. “We will continue to pursue every path toward resolution, including dialogue with the government.”
