Trump’s Trade Bombshell Rattles Markets—Then the Courts Drop the Hammer

Markets reel as former president slaps fresh tariffs on imports—just as a federal ruling throws sand in the gears. Classic case of ’buy the rumor, sell the news’—if you can even call this administration’s moves ’news’ anymore.

Customs Tariffs Lawsuit

We previously reported on the application made to the Federal Trade Court. The court ruled that Trump does not have the authority to apply comprehensive customs tariffs to the entire world. This step, which initiated a global trade war and undermined the global economy, has been invalidated by the court’s decision. However, Trump is not someone who gives up easily.

The ruling from the National Trade Court blocks measures under the 1977 International Emergency Economic Powers Act. Trump’s administration lawyers immediately announced their intention to appeal the decision.

Customs tariffs, initially imposed on Canada and Mexico under the National Emergencies Act (IEEPA), were extended globally at the beginning of April.

Emergency Situation Debates

While Congress holds the authority over customs tariffs, Trump perceives the current conditions as an emergency issue. The court commented on the ruling, which also prevents Congress from granting unlimited tariff authority to the President:

“Unrestricted delegation of tariff authority WOULD imply an improper relinquishment of legislative power to another branch of government.”

The court emphasized that the existing trade deficit issue does not fit the definition of an unusual and extraordinary threat. The decision will now be taken to the Federal Court of Appeals, and subsequently to the Supreme Court. The statement from the WHITE House reads:

“Determining how a national emergency is addressed is not the role of unelected judges. President Trump is committed to putting America first, and the administration is determined to use every arm of executive power to address this crisis and restore American greatness.”

New York Attorney General Letitia James called the final decision a victory for businesses and the rule of law. Satisfied with the verdict, the Attorney General stated that Trump disregarded the Constitution and imposed high taxes on the American people.
